Terms of Service

Welcome to ShotPulled ("the Service"). Please read these Terms of Service ("Terms") carefully before using the website, dashboard, or Model Context Protocol (MCP) endpoints operated by Bacosca Iulian PFA ("us", "we", or "our"), a sole trader established in Bucharest, Romania.

By accessing or using the Service, you agree to be bound by these Terms. If you disagree with any part of the terms, you do not have permission to access the Service.

1. Eligibility and Accounts

  • Age limit: You must be at least 16 years old to use ShotPulled.
  • Account security: You access the Service via our third-party identity provider (Clerk). You are responsible for maintaining the security of your authentication session and for immediately notifying us of any unauthorized use of your account.
  • Account isolation: We provide isolated data environments for each tenant; however, you may not attempt to breach, probe, or circumvent our multi-tenant security architecture.

2. Fair use and MCP endpoint / API usage

ShotPulled provides programmable interfaces, including an HTTP endpoint for the Model Context Protocol (MCP).

  • Rate limiting: We reserve the right to enforce automated rate limits on dashboard interactions and MCP API requests to ensure system stability and fair resource distribution for all users.
  • Prohibited activity: You agree not to abuse the API, use the Service to distribute malware, perform denial-of-service (DoS) attacks, or reverse-engineer the underlying application infrastructure for malicious purposes.

3. Your data and content

  • Ownership: You retain full ownership over all inventory data, shot logs, tasting notes, and equipment configurations you input into the Service.
  • License to us: You grant us a narrow, non-exclusive license to host, store, transmit, and back up your data solely to provide the Service to you. We do not sell your data or use it for advertising purposes.
  • Data deletion: You can request account closure and data erasure at any time by contacting privacy [at] shotpulled [dot] com, which we will execute within the timeframes outlined in our Privacy Policy.

4. Intellectual property

The Service and its original content (excluding user-generated coffee logs), look and feel, branding, dashboard design, and proprietary dialing-engine algorithms are and remain the exclusive property of Bacosca Iulian PFA and its licensors.

5. Third-party AI integrations (MCP disclaimer)

ShotPulled allows you to bridge your coffee logs with third-party LLM clients (such as Anthropic Claude, OpenAI ChatGPT, or Google Gemini) using the Model Context Protocol.

  • No vendor liability: We do not control, monitor, or accept liability for how third-party AI models interpret, process, or alter your data.
  • Use at your own risk: Any advice or grinder/recipe recommendations generated by an external AI assistant using ShotPulled data are informational and used at your own risk. We are not liable for wasted coffee beans, improper grinder calibration, or equipment damage resulting from AI-generated recommendations.

6. Service availability and "as-is" disclaimer

  • No warranties: ShotPulled is provided on an "AS IS" and "AS AVAILABLE" basis. We make no warranties, express or implied, regarding the continuous availability, uptime, accuracy of extraction mathematics, or error-free operation of the software.
  • Modifications: We reserve the right to modify, suspend, or discontinue any feature, API endpoint, or part of the Service at any time without prior notice.

7. Limitation of liability

To the maximum extent permitted by applicable law, in no event shall Bacosca Iulian PFA be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation loss of profits, data, use, goodwill, or other intangible losses, resulting from:

  1. Your access to or use of (or inability to access or use) the Service.
  2. Any conduct or content of any third party on the Service.
  3. Any content or recommendations generated through third-party AI clients using our MCP endpoints.

Nothing in these Terms excludes or limits liability that cannot be excluded or limited under applicable Romanian or EU law.

8. Governing law and jurisdiction

These Terms shall be governed by and construed in accordance with the laws of Romania and the European Union, without regard to its conflict-of-law provisions. Any legal action or proceeding arising under these Terms will be brought exclusively in the courts located in Bucharest, Romania.

9. Changes to these Terms

We reserve the right to update or replace these Terms at any time. For material changes, we will make a reasonable effort to notify active users via their registered email address at least 14 days before any new terms take effect. What constitutes a material change will be determined at our sole discretion.
